HA NOI (Biz Hub) — The Ministry of Information and Communications (MIC) has issued guidelines on domain name transfers in its newly-published draft circular on Internet resources.

According to the draft, organisations and individuals who have registered domain names legally retain the right to transfer these domain names to other organisations and individuals. In doing so, they must not violate the rights and legal benefits of related organisations and individuals, as well as covering the regulated taxes and fees.
The relevant parties will complete the transfer procedure through a registration agency. During the transfer process, other organisations and individuals are not allowed to register these domain names.
Organisations under the Communist Party of Viet Nam, state agencies, plus political and social organisations are not allowed to transfer domain names.
Domain names which are the subject of violations or disputes must not be transferred until these are resolved.
The draft circular also brings in regulations on the domain names themselves, banning words that violate the interest of the state or are not in line with national customs. Words in domain names must be clear and not open to misinterpretation.
The Telecommunications Law, which came into effect on July 1, 2010, contains regulations allowing organisations and individuals to transfer domain names but does not specify implementation instructions. — VNS
